Otestovali jsme novou databázi informačních povinností pro podnikatele

Snahou bylo spustit jednoduchý přehled legislativních povinností na jednom místě. Nová Databáze informačních povinností, která je určena podnikatelům, výsledky vyhledávání připomínají spíše nástroj pro úředníky, jak otestoval server Podnikatel.cz.

Databázi připravil resort se zástupci podnikatelů

Databáze, která je dostupná na adrese dip.gov.cz, je součástí opatření na snižování byrokracie v rámci Podnikatelského balíčku ministerstva průmyslu a obchodu. 

Databázi resort vytvořil ve spolupráci s podnikateli a podnikatelskými svazy a byla spuštěna pro letošní rok v pilotním režimu. Databáze poskytuje přehled informačních povinností pro podnikatele na jednom místě. Součástí je také srozumitelný popis a konkrétní zakotvení v příslušném právním předpisu. Díky tomu podnikatelé nemusí své povinnosti složitě hledat v zákonech, říká ministr průmyslu a obchodu Lukáš Vlček. 

Pro některé uživatele může být databáze matoucí

Na úvodní stránce se uživatel po rozkliknutí volby subjektu dostane na vyhledávací políčko, které požaduje položky jako číslo právního předpisu nebo rok vydání právního předpisu či klíčové slovo. 

Pokud podnikatel fyzická osoba zadá například do vyhledávání dotaz „živnostenský zákon“, vyjede mu tabulkový výpis 60 záznamů z živnostenského zákona. Pro rozkliknutí na detail vybrané povinnosti podnikatel získává další výpis informací.

Při zadání vyhledávacího pojmu „provozovna“ získává uživatel sice seznam všech povinností, které jsou s provozovnou spojeny, opět se ale jedná o výtahy ze zákona, které jsou pro běžné podnikatele místy nesrozumitelné.

Návod, jak databázi používat

Databáze vypadá spíše jako nástroj pro úředníky než praktická pomůcka pro běžné podnikatele

Celá databáze tak připomíná nástroj, který používají úředníci. Nikoli praktickou pomůcku pro podnikatele. Pilotní provoz navíc způsobuje časté výpadky databáze, což může uživatele odradit. Například po rozkliknutí na další stránky vyhledávání databáze v době testování hlásila, že zadanému textu nevyhovuje žádná povinnost. 

Databáze informačních povinností by přitom měla centralizovat povinnosti do jednoho přehledného rozhraní a poskytovat podrobnosti o každé z nich. Kromě popisu u každého právního předpisu obsahuje také informace o tom, jak a jakou formou lze povinnost splnit. Pokud je možné splnit ji elektronicky, databáze nabízí ID datové schránky, odkazy na formuláře či příslušné informační systémy úřadů, uvádí ministerstvo v tiskové zprávě. 

Poznámka: V době testování databáze často vypadávala, webová stránka nebyla kompletní a výsledky vyhledávání a funkčnost tak proto byly diskutabilní. Jedná se však o pilotní provoz, proto je nutné s výpadky počítat.
