Při plánování dovolených lidé často využívají tzv. last minute. Zájezdy na poslední chvíli většinou přináší finanční úsporu, v případě zaměstnanců ale také nejistotu, zda je zaměstnavatel ze dne na den na dovolenou uvolní. 

Situace vychází z běžné praxe, kterou se zabývá jeden ze čtenářů serveru Podnikatel.cz v diskuzích na Businesscentre.cz.

Problematika je obsažena v zákoníku práce, kde je jasně uvedeno, že termín dovolené vždy schvaluje zaměstnavatel. Ten má dokonce právo změnit určenou dobu čerpání dovolené nebo z ní zaměstnance v jejím průběhu odvolat. Měl by tak ovšem učinit v opravdu výjimečných situacích, které nedokáže vyřešit jinak a vyžadují přítomnost daného zaměstnance. Určenou dobu čerpání dovolené je zaměstnavatel povinen písemně oznámit zaměstnanci alespoň 14 dnů předem, pokud se nedohodne se zaměstnancem na kratší době.

Zákoník práce však také uvádí, že pokud není čerpání dovolené určeno nejpozději do 30. června následujícího kalendářního roku, má právo určit čerpání dovolené rovněž zaměstnanec. Čerpání dovolené je zaměstnanec povinen písemně oznámit zaměstnavateli alespoň 14 dnů předem, pokud se nedohodne se zaměstnavatelem na jiné době oznámení.
