Co je to elektronický platební rozkaz a k čemu může posloužit?

Elektronický platební rozkaz představuje zkrácené soudní řízení, které může být efektivním řešením, jak získat od dlužníků rychle zpět své peníze.

Využívá se především ve sporech o „nižší“ peněžité částky (maximálně do výše jednoho milionu korun) a jedná se o mnohem rychlejší způsob, jak se domoci svých práv, pokud nechcete jít cestou zdlouhavého soudního řízení. Při splnění zákonných podmínek se totiž dá očekávat vydání elektronického platebního rozkazu v řádu týdnů.

Co je třeba splnit k vydání elektronického platebního rozkazu?

Návrh na vydání elektronického platebního rozkazu je zvláštním druhem žaloby a vydává se pouze při splnění specifických zákonných podmínek. Jedná se o zkrácené řízení, které probíhá bez nařizování soudního jednání, přičemž soud rozhoduje pouze na základě předložených listinných důkazů. Soudy vydávají elektronické platební rozkazy zpravidla v řádu několika týdnů a tak se jedná o poměrně rychlou cestu k domožení se svých práv. Pro vydání elektronického platebního rozkazu je však nezbytné, aby bylo v žalobě uplatněno právo, kterým se nárokuje zaplacení peněžité částky. Žalobce nadto musí disponovat dostatkem listinných důkazů, ze kterých jeho právo na zaplacení vyplývá. Například podepsanou kupní smlouvu na prodej zboží, dodací list potvrzující předání zboží a fakturu po splatnosti. Současně je vhodné, aby žalobce před podáním návrhu na vydání elektronického platebního rozkazu nejdříve zaslal žalovanému předžalobní výzvu na adresu jeho bydliště nebo sídla, jinak mu v soudním řízení nemusí být přiznána náhrada nákladů soudního řízení.
