Vláda dnes nepodpořila senátní verzi novely daňového řádu a ani svoji původní. Pod stůl tak spadla řada jak pozitivních, tak negativních změn.

Novela sice ve vládní verzi počítala s tím, že podnikatelům prodlouží vratky DPH na 45 dnů, senátní úprava však tuto změnu, která by zhoršila cash-flow firem, rušila. Ministerstvo financí ovšem setrvalo na svých, podle odborníků zavádějících, tvrzeních a senátní verzi odmítlo. Koalice ale překvapivě neprohlasovala ani svoji původní verzi a celá novela tak spadla pod stůl.

Vláda neměla dost hlasů ani pro svoji verzi

Poslanecká sněmovna dnes hlasovala o novele daňové řádu, kterou ji vrátil Senát. Ve vládní verzi přinášela novela podnikatelům jak výhody, tak nevýhody. Mezi pozitiva patřil projekt Moje daně a online finanční úřad, který sliboval poplatníkům jednodušší vyřízení daňových povinností z domova nebo kanceláře. Těm, kteří by daňové přiznání podali elektronicky, se měla prodloužit lhůta pro podání daňového přiznání k daním z příjmů o 1 měsíc.

Součástí novely bylo i zrušení povinnosti podávat daňová přiznání elektronicky pro poplatníky, kteří si dobrovolně zřídili datovou schránku. S touto změnou souviselo i zmírnění pokut za nedodržení elektronické formy podání. Místo dosavadních 2000 Kč se mělo platit jen 1000 Kč.

V rámci daňové kontroly měla být nově připuštěna dálková forma komunikace. Díky tomuto opatření mělo dojít ke zkrácení jednotlivých fází daňové kontroly a zároveň k zamezení případných obstrukcí.

Dalším pozitivem bylo zavedení zálohy na daňový odpočet, která měla umožnit dřívější vrácení části nesporných částí nadměrných odpočtů na dani z přidané hodnoty. Plátcům DPH, u kterých se prověřuje pouze část nadměrného odpočtu, by se nesporná část odpočtu vyplácela v podobě záloh. K tomuto kroku bylo ovšem ministerstvo donuceno Ústavním soudem, který na konci loňského února konstatoval, že finanční správa smí zadržovat pouze tu část odpočtu DPH, o kterou vede spor.

Prodloužení lhůty na vratky DPH byla podpásovka

Novela nicméně obsahovala i několik podpásovek pro podnikatele. Návrh na zavedení záloh totiž ministerstvo spojilo s prodloužením lhůty pro vrácení nadměrného odpočtu z 30 dní na 45. Ministerstvo návrh vysvětlovalo tím, že lhůta tak musí být dostatečně dlouhá na to, aby správce daně mohl provést kvalitně svou vyhledávací činnost a zároveň stihl realizovat výplatu vzniklého vratitelného přeplatku. Jak ovšem upozorňovali odborníci, šlo o lichou argumentaci.

Změny úroků přinášely pozitiva i negativa

Návrh obsahoval komplexní revizi úroků a snižuje úroky z prodlení se zaplacením daně. Tzv. reparační úrok se snižoval na úroveň podle občanského zákoníku. Pozitivní pro podnikatele mělo být, že úrok z prodlení, který platí při zpoždění poplatníci, klesne o 6 procentních bodů, a úrok, který je vyplácen finančním úřadem poplatníkovi jako kompenzace za dlouhotrvající zadržení nadměrného odpočtu, se zvýší ze stávajících 4 % na 6 %.

Ruku v ruce s tím šlo ale i o negativum v podobě snížení úroků z neoprávněného jednání správce daně a zrušení úroků z nezákonného vymáhání daně. Úrok za neoprávněné jednání správce daně aktuálně činí REPO sazbu + 14 %. Pokud dnes navíc berňák neoprávněnou exekucí zabaví majetek a prostředky podnikatele, například na základě zajišťovacího příkazu, musí zaplatit dvojnásobný úrok. Nově má však úrok činit jednotnou sazbu ve výši REPO sazby + 8 %.

Negativem byl i návrh na zrušení toleranční lhůty. Došlo sice k úpravě, pro daň z příjmů a pro daň z nemovitostí se však měla zrušit.

Senátní verze negativa odstraňovala, vláda ji ale odmítla

Senátní verze pak většinu negativ pro podnikatele odstraňovala, především pak prodloužení lhůty pro vratky DPH z 30 na 45 dnů. Nejsou to žádné daňové úlevy, nejsou to žádné možnosti, kdy by mohly na základě toho vznikat daňové úniky, je to pouze právní jistota podnikatelů v již tak těžkém podnikatelském prostředí, které vzniklo sice nezaviněním nikoho, ale díky této pandemii, které jsme všichni svědky, vysvětloval poslancům senátor a daňový poradce Tomáš Goláň.

Školení pro účetní - podzimní novinky

Vládní koalice však senátní verzi odmítla. Podle ministryně financí Aleny Schillerové by totiž přinesla chaos. Koalice ovšem následně neměla dost hlasů ani na prohlasování vládní verze. K potřebným 101 hlasům jí totiž chyběli (nepočítaje omluvené) 3 nepřihlášení poslanci (po jednom z ANO, ČSSD i KSČM). Celý návrh tak spadl pod stůl.

Schillerová novelu opět předloží

Podle informací serveru Podnikatel.cz se však jedná o tom, že by ministerstvo financí opětovně novelu předložilo v nějaké kompromisní verzi, která by prošla i Senátem. Sama ministryně už na Twitteru uvedla, že novelu předloží znova. Zůstává otázkou, zda v ní opět bude, podle odborníků ničím neopodstatněné, prodloužení lhůty na vratky na DPH.
