HLAVA IV

SYSTEMIZACE

§ 14

(1) Systemizace ve službě a pro přípravu na službu vychází ze závazných pravidel pro organizaci služebních úřadů a hledisek pro účinné zajišťování úkolů v oborech služby; zahrnuje stanovení

a) počtu služebních míst řadových státních zaměstnanců klasifikovaných platovými třídami (§ 136 odst. 1),

b) počtu služebních míst představených podle § 9 odst. 3 a 4 klasifikovaných platovými třídami (§ 136 odst. 1),

c) objemu prostředků na platy státních zaměstnanců ve služebních úřadech,

d) počtu míst fyzických osob připravujících se na službu ve služebních úřadech klasifikovaných platovými třídami,

e) objemu prostředků na platy fyzických osob připravujících se na službu ve služebních úřadech.

(2) Návrh systemizace na příslušný kalendářní rok připravuje v předcházejícím roce generální ředitelství v součinnosti s Ministerstvem financí. Při přípravě návrhu systemizace vychází generální ředitelství z návrhů služebních orgánů, které je předkládají prostřednictvím nadřízených služebních orgánů. Nemá-li služební orgán nadřízený služební orgán, předkládá návrh generálnímu ředitelství přímo. Návrh systemizace projedná generální ředitelství s nadřízenými služebními orgány, nemá-li služební úřad nadřízený služební orgán, projedná generální ředitelství návrh systemizace s příslušným služebním orgánem.

(3) Návrh systemizace obsahuje souhrnné údaje podle odstavce 1 za ústřední správní úřady a souhrnné údaje za jim podřízené správní úřady a souhrnné údaje za správní úřady, které nemají nadřízený správní úřad.

(4) Systemizaci na příslušný kalendářní rok schvaluje vláda v předcházejícím roce. Vláda je oprávněna upravit v souvislosti se schvalováním systemizace organizační strukturu služebního úřadu [§ 11 odst. 4 písm. b)]. Návrh systemizace vládě předkládá předseda vlády.

(5) Podle vládou schválené systemizace (odstavec 4) a závazných pravidel pro organizaci služebních úřadů [§ 11 odst. 4 písm. b)] služební orgány zpracují návrhy organizačních struktur služebních úřadů a služební orgán je prostřednictvím nadřízených služebních orgánů předloží generálnímu řediteli.

(6) Služební místa a finanční prostředky na platy státních zaměstnanců, místa a finanční prostředky na platy fyzických osob připravujících se na službu podle schválené systemizace nesmějí být použity pro jiný než stanovený účel.

(7) Schválenou systemizaci postoupí generální ředitel Ministerstvu financí v termínu navazujícím na harmonogram zpracování návrhu státního rozpočtu.

§ 15

Změna systemizace, jejímž důsledkem je změna počtu služebních míst nebo změna platové třídy státního zaměstnance, je přípustná, jen dojde-li ke změně působnosti služebního úřadu na základě zvláštního zákona, nebo k podstatné změně podmínek, za kterých byla schválena. Změnu systemizace schvaluje vláda.

§ 16

(1) Služební orgány předkládají generálnímu ředitelství na základě závazných pravidel pro organizaci služebních úřadů návrh systemizace (§ 14 odst. 1) a návrh organizační struktury služebních úřadů v termínu stanoveném generálním ředitelstvím prostřednictvím nadřízených služebních orgánů. Nemá-li služební orgán nadřízený služební orgán, předkládá návrh generálnímu ředitelství přímo.

(2) Návrh systemizace a návrh organizační struktury služebních úřadů, jimiž jsou ministerstva nebo Úřad vlády, se připravují v součinnosti se členem vlády, který řídí příslušné ministerstvo, nebo s vedoucím Úřadu vlády.

(3) Generální ředitelství je oprávněno návrh podle odstavce 1 přezkoumat a vyžádat si jeho doplnění nebo přepracování.

(4) Služební orgány jsou povinny požadavku podle odstavce 3 vyhovět.
